Program Overview
The attorney becomes an agent of the underwriter (Fidelity National Title Insurance Company, First American Title Insurance Company or Commonwealth Land Title Insurance Company) with support services agreement provided by Heritage Title Company.
Fee
There is no fee to join.
Liability
The Attorney becomes a free standing authorized agent with full support of both the underwriter and Heritage Title Company. The Agent can count on informed support and advice from our title insurance experts.
Licensing
The Attorney is required to submit an application which is reviewed by the underwriter for approval. Simultaneously, with the application, the Attorney receives the following;
- An Agency Agreement between the Attorney and the underwriter;
- A Support Services Agreement between the Attorney and Heritage Title Company;
- An application for registration as a title insurance agent.
These forms will be executed, notarized and submitted through Heritage Title Company to the underwriter(s).
Orders can be processed by an Attorney Agent once you are in receipt of a fully executed Agency
Examining Title
Within three to four days after placing an order, the Attorney Agent will receive a search package which includes the examination worksheet, abstract and support documents to be used by the Agent to determine the insurability of title. The Agent's completed title examination must be returned to Heritage Title Company to allow us to process the title commitment.
Closings
Closing will be conducted by Heritage Title Company. The Attorney Agent is responsible for handling all clearance and waiving exceptions on the title commitment at closing. The Agent also directs the issuance of policies.
